NEW YORK, NY—Clifton Budd & DeMaria LLP recently hosted a special presentation on “Drafting and Enforcing Restrictive Covenants” on Thursday, June 25, 2009. The seminar was led by Daniel C. Moreland, a partner, and Matthew Siebel, an associate, in the Saybrook Room of the Yale Club, located at 50 Vanderbilt Avenue in New York.
The program addressed how employers can protect their most valued assets in today’s economic climate. Specific issues included how to protect client, employee and confidential information through the enforcement of restrictive covenants. The presentation on “Drafting and Enforcing Restrictive Covenants” provided practical guidance on how to analyze what specific types of agreements, contents and restrictions are available and appropriate for an employer. The seminar also explained how to enforce restrictive covenants up to and including litigation.
Topics of discussion included the drafting and enforcement of the following types of agreements:
• Confidentiality agreements;
• Non-solicitation of client agreements;
• Non-solicitation of employee agreements; and
• Non-compete agreements.
ABOUT DANIEL C. MORELAND
Daniel C. Moreland, a Partner with Clifton Budd & DeMaria, LLP, concentrates on the representation of management in all aspects of employment and labor law. In his practice, Moreland works with clients to develop and refine employment practices and procedures, such as employment handbooks and employment applications, to comply with local, state and federal labor and employment law. Moreland attended the State University of New York at Buffalo where he received his Juris Doctor, and the New York State School of Industrial and Labor Relations at Cornell University, where he earned a Bachelor of Science degree, with honors.

Matthew A. Siebel is an Associate at Clifton Budd & DeMaria, LLP, who focuses on the representation of management in all aspects of labor and employment law. Siebel has extensive experience defending employers in all manners of employment disputes including claims of discrimination, denial of leave rights, wage and hour violations, harassment, wrongful discharge and breach of employment contracts. He also counsels employers in traditional labor matters, including collective bargaining negotiations, unfair labor practice proceedings and arbitrations.
Siebel partners with his clients to avoid litigation by providing daily advice on remaining compliant with employment laws, reviewing and revising handbooks and personnel policies, negotiating separation agreements, and conducting training seminars. Siebel received his Juris Doctor from the Syracuse University College of Law and also completed a Bachelor of Arts degree at Lehigh University.
